TERMS & CONDITIONS

Minushay Event Stationery (ABN 246 378 542 30) agrees to perform works, services or supply deliverables to you as agreed in writing, in consideration for the fees described in any communication offering our works, services or deliverables on these terms and conditions, creating an agreement for the supply of our works, services or supply of deliverables.  

Terms

The agreement shall commence on the commencement date set out in any offer made, and shall terminate on completion of our work, services or any specified date.   

Design Ownership - Copyright 

Minushay Event Stationery retains and will solely and exclusively own all intellectual property created and designed, whether existing or bespoke and we are permitted to use any design pieces for future layouts and may add them to our website for future customer purchase. All violations of our intellectual property or copyright will be pursued.  

Any files exchanged during our communication and containing our intellectual property, is explicitly provided to you for your review and approval only, this is the only use of our digital property that you are permitted that is provided to you.

Minushay Event Stationery reserves the right to reproduce any work or part of any part of work that we produce or collaborate on, for marketing / promotional purposes. Minushay Event Stationery reserves the right to use any work or design(s) produced or provided to you and can photograph such work or design(s) for advertising in print, online wedding directories, across social media, throughout website galleries and in digital multi-channel marketing. if you do not wish to have photos of your event pieces posted, please discuss this requirement with us when you place your order.  

Liability 

All intellectual property, art work and literary works supplied to Minushay Event Stationery are warranted by you for its copyright and / or licensing and you are authorising Minushay Event Stationery to reproduce any of the works. You indemnify Minushay Event Stationary for any and all losses as a result of any breach of rights associated with any intellectual property, art work and literary works that you provide to Minushay Event Stationery.  

Currency 

All amounts payable to us will be in Australian dollars and inclusive of GST at 10%. We reserve the right to update our pricing at any time without notice. GST is applicable to all orders.  

Payment of Orders 

For any of our semi-tailored collections, full payment is required for every job before printing will be commenced. For bespoke orders and designs, an initial payment of 25% is to be made before design commences with full payment required before printing will be commenced.

If extra changes are made to your event stationery order which adds to the price, your products will be held until all payment has been cleared. In any event, payment is due within ten (10) business days of any invoice provided to you. Once confirmed and invoiced, unless otherwise agreed the amounts invoiced are not refundable.   

 Sample Proof & Proofreading 

A pdf proof will be emailed to you for final approval before printing. Please check the pdf carefully for any mistakes. Minushay Event Stationery will not be held accountable for any mistakes to the products after you have approved the proof. Any amendments made after approval and printing will incur an extra charge. 

If there is a printing error made on our part, we will at our sole election: either reprint the paper goods or provide a credit for the misprint. If there is an error with the wording that was approved by you, you will bear the the costs of reprinting.  

Personalisation of Products 

If you would like guest names to be added to your invitations, you will need to supply us with an excel spreadsheet with all names typed exactly how you would want them to appear, ie. Katie and Thomas, Mr & Mrs Morris etc. We will supply you with a blank spreadsheet upon discussing your order. 

For place cards, please use one (1) name per line, ie. Tim, Sarah, Harry etc. 

Please ensure you have checked spelling and spacing before you send your list to us. Any errors supplied by yourself will be reprinted at your expense.  

Bespoke Design 

We do offer a bespoke design service for invitations and matching stationery. The design fee will be based on your brief and printing will be charged at the same rate as our semi-tailored collections. We ask that you send us as clear a brief as you can muster, including any inspiration you have in terms of fonts, theme, images, colours and style so we can save you from additional artwork fees. 

Note: The bespoke design fee covers our design time. It does not entitle you to receive any finished artwork file or works used or involving this work that we have created. Any designs Minushay Event Stationery creates vest in and remains the sole property of Minushay Event Stationery upon creation. 

Our custom design fee allows for three (3) rounds of changes to your design. Further changes will be charged at $90/hour.  

Minimum Quantity 

We have minimum order quantities for most items. For invitations, this is generally a minimum of 50 items. Please contact us if you require less than the specified minimum as there will be a fee that applies depending upon the actual quantity required.  

Postage 

All packages will be sent by Australia Post or courier and will require a signature. Minushay Event Stationery is not liable for any damage caused by third parties as we take great care in packaging your order.  

Supplying Images 

Some invitations and thank-you card designs will allow you to use one (1) or more of your own photos. You can supply your images by email (preferable) if the total file size is under 7mb, or we accept delivery via Dropbox. Please ensure digital images are high quality, as they may be rejected if not of a high enough resolution for printing. We will assess images for lack of quality and advise if they need to be replaced with one of a higher resolution. Minushay Event Stationery is not responsible for variations in colour, darkness / lightness and quality to that of prints from other sources.  

Image Ownership 

By supplying images to us for use in products, you certify that:  

You are the parent or guardian of the child, or have received permission directly from the child’s parent or guardian to use the photographs provided. 

You have the permission of your photographer to use any images supplied, if they are taken by a professional photographer.

Minushay Event Stationery have the right to refuse images and / or cancel your order if we suspect your images may infringe copyright laws.  

Cancellations and Refunds 

Please choose products carefully. Due to the time and expenses involved in creating our products, we cannot refund payment once your products are printing. We do not refund or exchange for change of mind. We will replace any goods deemed to be faulty, but not provide credit. We encourage you to purchase a sample pack before ordering so you can see our quality. Refunds are available for major faults / defects as per Australian Consumer Law.  

Loss or Damage to Goods 

Minushay Event Stationery cannot be held responsible for any loss or damage in transit once the order has been dispatched. We will take the utmost of care to ensure safe and appropriate packaging and delivery methods are used. You will be supplied with a tracking number (either Australia Post or courier) when your package is dispatched.  

Privacy Information 

We respect our customers privacy, and comply with the Australian Privacy Law.  

Your details may be provided to a third party only however to the extent required for ordinary business operations. Your information will remain confidential and will only be used to process your order or inform you of offers which may interest you. 

Representations  

You agree that Minushay Event Stationery has not made any warranty or representation, express or implied, in relation to our works, services or supply of deliverables, including whether they are suitable for a particular purpose (whether such purpose was made known to Minushay Event Stationery or not), unless provided in writing. 

No implied Terms 

To the extent permitted by law, all express or implied warranties, representations, statements, terms and conditions relating to Minushay Event Stationery or the provision of our works, services or supply of deliverables under these terms and conditions, are excluded from the agreement between the parties. If a condition or warranty is implied into this agreement by a law which cannot be excluded, Minushay Event Stationery's liability is limited at the option of Minushay Event Stationery, to the supply of the defective services or deliverables again or the payment of the cost of having the defective services or deliverables supplied again. 

Limitation of Liability  

Minushay Event Stationery's aggregate liability, whether arising from breach of contract, negligence or any other tort, breach of warranty, under an indemnity, or statute, in equity or otherwise is limited to an amount equal to the total amount paid to Minushay Event Stationery for the works, services or supply of deliverables. 

Minushay Event Stationery is not liable for any indirect, incidental, special or consequential loss or damage, or for loss of use, revenues, profits, goodwill, bargain or loss of opportunities, anticipated savings, or loss of or corruption of data, whether arising from breach of contract, negligence or any other tort, in equity, or under an indemnity, warranty or otherwise, and whether or not Minushay Event Stationery was aware of the possibility of such loss or damage. 

General  

If any of these terms and conditions are for any reason declared to be or become unenforceable, invalid or illegal, the remaining Terms will remain in full force and effect. 

These terms and conditions are governed by the laws of Victoria and the parties agree to submit to the non-exclusive jurisdiction of the courts of Victoria. 

These terms and conditions, any written offer (accepted) and promise to pay constitute the entire agreement between the parties on the subject matter and supersede any previous understanding or agreement on that subject matter.
